Competition law and consumer rights
- preparation and implementation of company-wide solutions to ensure compliance of market activities with Polish and EU competition law; assessment of antitrust risk
- contract analysis to identify provisions that may be considered anti-competitive; drafting new contract templates to eliminate the risk of provisions being deemed anti-competitive practices
- analysis of a business entity’s conduct to assess whether specific actions may constitute an abuse of dominant position
- implementation of internal measures to prevent breaches of competition law by employees and associates of the company
- support for businesses in disputes with competitors and protection against acts that may be considered unfair competition
- comprehensive legal services in the field of consumer protection, including review of consumer contracts for compliance with applicable consumer protection laws and the presence of abusive clauses; preparation of new contract templates in line with current case law
- advising on appropriate remedial measures in response to identified violations
- participation in inspections conducted by the Office of Competition and Consumer Protection (UOKiK), representation in explanatory and antitrust proceedings before the President of UOKiK and in appeal proceedings before the courts
- assessment of the obligation to notify the intention of a merger to the President of UOKiK or the European Commission, preparation of merger notifications and representation of Clients throughout the merger control process
